- Who can enter: Open to anyone who is 19 years of age or older. Void where
prohibited or restricted by law or regulation. Not eligible are employees
and their immediate families, including household members of
DiscoverTheIslands.Com (Sponsor), or its agents, affiliates, subsidiaries,
divisions, and advertising and promotion agencies.
- How to enter: Stage One of the
Promotion begins at 8:00 a.m. PST April 30, 2002 and ends at midnight March 31, 2004. To enter you must complete an official DiscoverTheIslands.Com Contest
Entry Form available at http://www.discovertheislands.com/contest_entry.html. Shortly after we receive the last
Contest Entry Form we will email all selected contestants with instructions. Participation in the focus groups/personal interviews, surveys or treasure hunts is what constitutes eligibility
for prizes in any Stage.
- What you can win:
PRIZES: The Prizes are comprised of: a) a DiscoverTheIslands.Com silk-screened t-shirt, in the Focus Group of Stage One; b) Samsonite Oyster Series luggage in Focus Group or Treasure Hunt of Stage Two; and c) a Vacation for two on an island destination in the online or mail survey of Stage Three. d) Stage Four, if offered, shall consist of a Vacation for six people at an exclusive island resort. Details of Stage Four, if offered, will be provided at a future date. Approximate retail value (ARV) of the entire prize package is 16 t-shirts valued at $672.00, luggage valued at $500.00, 1 Vacation package for two valued at $3,000.00, 1 Vacation package for six valued at $10,000 for a total of $14,172.00.
i. DiscoverTheIslands.Com will select the
Prize-winners in a random drawing. DiscoverTheIslands.Com will continue to
select Prize-winners until the allotted number of Prizes are awarded.
ii. Contestants who participate in the Stage One
Focus Group receive a colorful DiscoverTheIslands.com silk-screened t-shirt. Stage Two contestants must take part in the Focus Group to be eligible for the Samsonite luggage draw. The names of Contestants who participate in either the Focus Groups or Personal Interviews of
Stages One and Two will be entered in the random draw of a Vacation for two on an island destination.
iii. In Stage Three, Contestants will complete an online or mail survey. DiscoverTheIslands.Com will randomly
select a winner of the Vacation Package for two prize from among those who participated in the Focus Groups or Personal Interviews of Stages One and
Two and those who completed the survey of Stage Three.
iv. Prize Winners will receive notification
of their prize via email. In the event that a Prize Winner does not respond to
a Winner Notification within seven (7) days, DiscoverTheIslands.Com will issue
a second and final notification. Should
the Prize Winner fail to respond to the second and final notification within
seven (7) days, the Prize Winner shall be deemed to have forfeited the prize.
DiscoverTheIslands.Com will then select an alternate winner.
4. Timing: To be eligible to win, all responses to
the first Focus Group and Personal Interviews of Stage One must be received by midnight August 20, 2004.
Sponsor reserves the right to verify eligibility qualifications of any winner.
If a Canadian resident wins a prize, that person must also answer correctly
within a 5 minute time period a mathematical skill-testing question without the
benefit of any human, mechanical or electronic calculating devices before the
prize will be awarded. It is the sole responsibility of the entrant to notify
the Sponsor in writing if the entrant changes his or her email address. To do
so, email info@DiscoverTheIslands.org
and type "Contest Address change" in the subject line. Prize Winners may be required to complete an
Affidavit of Eligibility and Publicity/Liability Release and return it,
notarized, within ten (10) business days. Each Winner must consent to the use
of his/her name and/or photograph for promotional purposes without additional
compensation, unless prohibited by law. Failure to return the completed
Affidavit in the time required will result in disqualification and forfeiture
of the prize. All unclaimed prizes (Stage One) as of 5:00 pm August 25, 2004 will
be forfeited.
5. Miscellaneous: Incomplete entries are void. All federal,
state, local and provincial taxes and all income and any other taxes, fees and
surcharges will be the sole responsibility of the prizewinner. Persons found
tampering with or abusing any aspect of this contest as solely determined by
Sponsor will be disqualified. In the event that the contest is compromised by a
virus, bugs, non-authorized human intervention, or other causes beyond the
control of Sponsor, which corrupt or impair the administration, security,
fairness or proper play of the sweepstakes, Sponsor reserves the right, in its
sole discretion, to suspend or terminate the Promotion. Should the Promotion be
terminated prior to the stated expiration date, notice will be posted at contest termination.
6. Conditions of entry:
By entering, entrants (i) agree to comply with these Official Rules including
all eligibility requirements, (ii) agree to be bound by the decisions of the
Sponsor, which are final and binding in all respects, and (iii) agree that no
claim relating to and damages, losses or injuries shall be asserted against
Sponsor, or its agents, affiliates, subsidiaries, divisions, and advertising
and promotion agencies. All entries become the property of Sponsor. This
contest may be subject to Canadian laws and regulations. Sponsor and its
agents, affiliates, subsidiaries, divisions, and advertising and promotion
agencies (i) make no warranty, guaranty or representation of any kind concerning
any prize, (ii) disclaim any implied warranty, and (iii) are not in any way
responsible or liable for damage, loss or injury resulting from altered, late,
lost, damaged, misdirected, mutilated, inaudible, garbled, illegible or
incomplete entries, or human, telephone, computer, online, or technical
malfunctions or failures (including network unavailability and disconnections),
or acceptance and use of a prize or travel in connection with such prize.
Sponsor is not liable for misdelivered or nondeliverable prizes due to
inability to deliver because of incomplete or inaccurate email or address
information or any complication with the delivery service rendering the package
containing the prize nondeliverable. Proof of transmission and/or mailing does
not constitute proof of delivery. Entries will be deemed to have been submitted
by the authorized account holder of the email address submitted at the time of
entry. "Authorized account holder" is defined as the natural person
who is assigned to an e-mail address by an Internet access provider, online
service provider or other organization responsible for assigning e-mail
addresses for the domain associated with the submitted e-mail address.
7. Use of Contest Information/Privacy: DiscoverTheIslands.Com reserves the right to use all information, including information on entrants obtained through the contest. DiscoverTheIslands.Com may share e-mail address and sell or share certain information with our affiliates and with carefully selected companies who we think can offer you services and products of interest to you. We use non-identifying and aggregate information to better design our website and to share with advertisers. For example, we may tell an advertiser that X number of individuals visited a certain area on our website, or that Y number of men and Z number of women filled out our subscription form, but we would not disclose anything that could be used to identify those individuals. We also allow access to our database by third parties that provide us with services, such as technical maintenance, but only for the purpose of and to the extent necessary to provide those services. And if you choose to purchase items through features on our site, we may forward your information to third parties for services such as credit card processing and order fulfillment. We use return email addresses to answer the email we receive and to keep you informed of contest developments of interest to you. There are also times when you provide information about yourself to us in areas of the site that are managed or participated in by third parties, such as our featured merchant partners. In such cases, the information may be used by us and by such third party(ies), each pursuant to its own policies. We may also provide your information to our advertisers, so that they can serve ads to you that meet your needs or match your interests. While DiscoverTheIslands.Com will seek to require such third parties to follow appropriate privacy policies and will not authorize them to use this information except for the express purpose for which it is provided, DiscoverTheIslands.Com does not bear any responsibility for any actions or policies of third parties. There may also be occasion when we are legally required to provide access to our database in order to cooperate with police investigations or other legal proceedings. In those instances, the information is provided only for that purpose. Entrants who opt to join DiscoverTheIslands.Com’s electronic mailing list by submitting a Contest Entry Form agree to be contacted by email by DiscoverTheIslands.Com.
8. Additional Terms:
Any and all disputes relating to this Promotion or any prize shall be subject
to the policies of DiscoverTheIslands.Com which may include appointing an arbitrator.
